The incident in May-June 2007 involving a U.S. citizen traveling internationally while infected with drug-resistant tuberculosis involved the U.S. federal government's application of its quarantine and isolation powers. The incident and the isolation order raised numerous important issues for public health governance, law, and ethics. This article explores many of these issues by examining how the exercise of quarantine powers provides a powerful lens through which to understand how societies respond to and attempt to govern threats posed by dangerous, contagious (...) pathogens. The article considers historical aspects of governmental power to quarantine and isolate individuals and groups; analyzes the current state of quarantine and isolation law in the United States in light of the recent incident with drug-resistant tuberculosis; and explores global aspects of public health governance and law highlighted by this incident. In lieu of an abstract, here is a brief excerpt of the content:189 HUME'S MORAL ONTOLOGY* My concern here is the claim, made in my recent book, that Hume is a moral realist. In general terms I would describe this book as one of several that represent a sustained effort to consider Hume within an eighteenth-century context, an effort to see him not as a timeless figure, or to treat him as a brilliantly successful contemporary of ourselves, but as a (...) brilliant eighteenth-century philosopher responding to eighteenth-century issues with, for all his timelessness, eighteenth-century conceptual tools and 2 from an eighteenth-century perspective. It would be hopelessly naive to suppose that any of us can view Hume without any historical distortion, but it is equally naive to read Hume, as he is often read, without historical sensitivity. Furthermore, such insensitivity closes us off from what is uniquely valuable about Hume, for, instead of seeing his writings as the consequence of his unique efforts to confront and answer the philosophical questions posed to him, the historically insensitive read into him their own questions and their own answers. The past studied as an echo of the present is of little interest (and none of that intrinsic), nor can there be much value in the study of those who saw but through a glass, darkly, the truths now so apparent to us. Our intellectual past is important to us because it is different from our intellectual present, and not because it seconds what we presume already to know. I was entirely serious, then, when I said that both the plausibility, and the very meaning of my claim that Hume is a common-sense moralist or a moral realist depends upon considering this claim — and, consequently, Hume — within a particular philosophical context. It will not do to suppose that moral realism 190 is a term with an eternal, unchanging, and Platonic connotation, and then to reject my suggestion outright because Hume was, as I would certainly agree, virtually without sympathy for anything revealing a tincture of Platonism. Philosophical terms as well as philosophical issues are historical, changing entities; it is those who think or act otherwise who smuggle 4 Platonism into the discussion. Doubtless, however, some of the misunderstanding to which I refer is my own responsibility. I can join Hume in saying "I have found by experience, that some of my expressions have not been so well chosen, as to guard against all 5 mistakes in the readers," and so I shall here offer some clarifications of my view. I. To begin, I wish to bring together in one place evidence of the significant qualifications I put on my claim about Hume's moral realism. Taken together, these remarks show that my position is consistent with the widely held (and generally correct, I would say) view that Hume is in one highly important sense a naturalist, and that I ascribe to him a realism that is neither Platonic, Scholastic, Cartesian, nor Hutchesonian: A. If naturalism is thought to be the view "that the whole of the universe or experience may be accounted for by a method like that of the physical sciences," then Hume must certainly be called a naturalist because of his efforts to extend the "experimental Method of Reasoning into moral Subjects".... Hume is a naturalist in that he sought to produce coherent philosophical explanations without the slightest recourse to supernatural entities or transcendental principles... an obvious example of this kind of naturalism... is his attempt to explain moral values as derived from human nature or from, that is, human beings as constituted and active in the world (DH 15-16). 191 B. This study uses a “science pipeline” model and cross-national data to examine women's participation in science education and occupations in seven countries. Gender stratification in later science education and in science occupations is found in every country examined. Young women's participation in science education decreases with each stage in the science pipeline, but there is considerable cross-national variation in the extent of gender stratification in science. Findings show greater gender stratification in science occupations than in science education, suggesting factors other (...) than training help maintain inequality in high-status science occupations. The remember–know paradigm is one of the most widely used procedures to examine the subjective experience associated with memory retrieval. We examined how the terminology and instructions used to describe the experiences of remembering and knowing affected remember–know judgments. In Experiment 1 we found that using neutral terms, i.e., Type A memory and Type B memory, to describe the experiences of remembering and knowing reduced remember false alarms for younger and older adults as compared to using the terms Remember and (...) Know, thereby increasing overall memory accuracy in the neutral terminology condition. In Experiment 2 we found that using what we call source-specific remember–know instructions, which were intended to constrain remember judgments to recollective experiences arising only from the study context, reduced remember hits and false alarms, and increased know hits and false alarms. Based on these data and other considerations, we conclude that researchers should use neutral terminology and source-specific instructions to collect the most accurate reports of the experiences of remembering and knowing arising from the study context. ABSTRACTIt is proposed that experts are able to integrate prior contextual knowledge with emergent visual information to make complex predictive judgments about the world around them, often under heightened levels of uncertainty and extreme time constraints. However, limited knowledge exists about the impact of anxiety on the use of such contextual priors when forming our decisions. We provide a novel insight into the combined impact of contextual priors and anxiety on anticipation in soccer. Altogether, 12 expert soccer players were required (...) to predict the actions of an oncoming opponent while viewing life-sized video simulations of 2-versus-2 defensive scenarios. Performance effectiveness and processing efficiency were measured under four conditions: no contextual priors about the action tendencies of the opponent and low anxiety ; no CP and high anxiety ; CP and LA; CP and HA. The provision of contextual priors did not affect processing efficiency, but it improved performance effectiveness... (shrink)

Although existentialism and evolutionary biology might appear to be polar opposites, with the former denying a role for “human nature” and the latter emphasizing it, there are some unrecognized parallels. One in particular is that both disciplines assume that human life is not inherently meaningful, such that any attribution of meaning must arise from human actions. The present article traces some of this intellectual correspondence in the realm of literature.

The principle of alternate possibilities (PAP), making the ability to do otherwise a necessary condition for moral responsibility, is supposed by Harry Frankfurt, John Fischer, and others to succumb to a peculiar kind of counterexample. The paper reviews the main problems with the counterexample that have surfaced over the years, and shows how most can be addressed within the terms of the current debate. But one problem seems ineliminable: because Frankfurt''s example relies on a counterfactual intervener to preclude alternatives to (...) the person''s action, it is not possible for it to preclude all alternatives (intervention that is contingent upon a trigger cannot bring it about that the trigger never occurred). This makes it possible for the determined PAPist to maintain that some pre-intervention deviation is always available to ground moral responsibility. In reply, the critic of PAP can examine all the candidate deviations and argue their irrelevance to moral responsibility (a daunting prospect); or the critic can dispense with counterfactual intervention altogether. The paper pursues the second of these strategies, developing three examples of noncounterfactual intervention in which (i) the agent has no alternatives (and a fortiori no morally relevant alternatives), yet (ii) there is just as much reason to think that the agent is morally responsible as there was in Frankfurt''s original example. The new counterexamples do suffer from one liability, but this is insufficient in the end to repair PAP''s conceptual connection between moral responsibility and alternate possibilities. (shrink)

The Logic of Leviathan The Moral and Political Theory of Thomas Hobbes.

The goal of this paper is to stress the significance of ethics for engineering education and to illustrate how it can be brought into the mainstream of higher education in a natural way that is integrated with the teaching objectives of enriching the core meaning of engineering. Everyone will agree that the practicing engineer should be virtuous, should be a good colleague, and should use professional understanding for the common good. But these injunctions to virtue do not reach closely enough (...) the ethic of the engineer as engineer, as someone acting in a uniquely engineering situation, and it is to such conditions that I wish to speak through a set of specific examples from recent history. I shall briefly refer to four controversies between engineers. Then, in some detail I shall narrate three historical cases that directly involve the actions of one engineer, and finally I would like to address some common contemporary issues. The first section, “Engineering Ethics and the History of Innovation” includes four cases involving professional controversy. Each controversy sets two people against each other in disputes over who invented the telegraph, the radio, the automobile, and the airplane. In each dispute, it is possible to identify ethical and unethical behavior or ambiguous ethical behavior that serves as a basis for educational discussion. The first two historical cases described in “Crises and the Engineer” involve the primary closure dam systems in the Netherlands, each one the result of the actions of one engineer. The third tells of an American engineer who took his political boss, a big city mayor, to court over the illegal use of a watershed. The challenges these engineers faced required, in the deepest sense, a commitment to ethical behavior that is unique to engineering and instructive to our students. Finally, the cases in “Professors and Comparative Critical Analysis” illuminate the behavior of engineers in the design of structures and also how professors can make public criticisms of designs that seem wasteful. This paper examines the interactive effects of apology source and apology components on forgiveness. Results revealed a significant source by component interaction. A remorseful employee apology was more successful than a remorseful CEO apology because consumers felt more empathy for the employee. Furthermore, a compensatory CEO apology was more effective than a compensatory employee apology because CEOs could significantly affect consumer perceptions of justice. The purpose of this article is threefold: to examine the elements of an artful apology; to sequence them in a comprehensive configuration; and to use the taxonomy for assessing the effect of public apologies. The model identifies seven sequential components of an apology: revelation, recognition, responsiveness, responsibility, remorse, restitution, and reform. Also included in the model are four deflective stratagems: dissociation, diminution, dispersion, and detachment. Analysis focuses on actual offense situations rather than artificial simulated settings. Specifically, the study examines whether (...) seven well-publicized apologies conform to the proposed construct. The Sociosexual Orientation Inventory (SOI; Simpson & Gangestad 1991) is a self-report measure of individual differences in human mating strategies. Low SOI scores signify that a person is sociosexually restricted, or follows a more monogamous mating strategy. High SOI scores indicate that an individual is unrestricted, or has a more promiscuous mating strategy. As part of the International Sexuality Description Project (ISDP), the SOI was translated from English into 25 additional languages and administered to a total sample of 14,059 people (...) across 48 nations. Responses to the SOI were used to address four main issues. First, the psychometric properties of the SOI were examined in cross-cultural perspective. The SOI possessed adequate reliability and validity both within and across a diverse range of modern cultures. Second, theories concerning the systematic distribution of sociosexuality across cultures were evaluated. Both operational sex ratios and reproductively demanding environments related in evolutionary-predicted ways to national levels of sociosexuality. Third, sex differences in sociosexuality were generally large and demonstrated cross-cultural universality across the 48 nations of the ISDP, confirming several evolutionary theories of human mating. Fourth, sex differences in sociosexuality were significantly larger when reproductive environments were demanding but were reduced to more moderate levels in cultures with more political and economic gender equality. Implications for evolutionary and social role theories of human sexuality are discussed. This paper examines the interpretation of Hobbes as a political formalist which is developed by F. S. McNeilly in The Anatomy of Leviathan. McNeilly argues that Hobbes's demonstration of the necessity of political society is independent of Hobbes's particular view of man as an egotist bent at all costs on his own preservation. The first part of the argument of the paper uses techniques of decision theory and game theory to show that this argument which McNeilly ascribes to Hobbes is (...) not valid. However, the argument which Hobbes is traditionally supposed to put forward is shown to be valid. The second part of the paper examines McNeilly's interpretation of the text of Leviathan and shows that he has insufficient grounds for supposing that Hobbes attempted to construct a purely formal science of politics.
